Trusts:

There are two (2) types of trusts:

Testamentary Trusts are part of a Will, and are created when the person that made the Will dies.

Living (Inter Vivos) Trusts are not part of a Will, they are a separate document, and are created when signed.

 

Also important is the difference between Revocable Trusts and Irrevocable Trusts.  Revocable Trusts can be changed (amended) after being created, Irrevocable Trusts cannot.

All Testamentary Trusts, once created, are Irrevocable since the person making the Will that created the Trust is dead when the Trust is created.  If the person making the Will (with a Testamentary Trust in it) is still alive, he may change the trust by changing his Will.
